Trademarks and industrial designs – in Poland and across the EU
A name, logo, packaging or product shape is often a company’s most valuable asset. I help you register, monitor and defend it. I am a registered professional representative before the EU Intellectual Property Office (EUIPO, no. 107937) and handle cases before the Polish Patent Office.
Typical situations
When clients usually get in touch.
- I am launching a new brand or product and want to be sure the name is free and will be mine.
- I received a cease-and-desist letter, for example as a seller on Allegro or Amazon.
- A competitor has filed a similar mark or is copying my product.
- I am expanding abroad and need protection across the European Union.
- I am selling my business, contributing a brand to a company or granting a licence.

Trademarks in Poland and the EU – frequently asked questions
How do I register a trademark in Poland?
You file an application with the Polish Patent Office for protection in Poland, or with the EUIPO for protection across the European Union. Registering a company name in the Polish business register does not give you exclusive rights to it as a trademark.
How much does trademark registration cost?
The cost consists of official fees, which depend on the office and the number of classes, and the representative’s fee. I always agree my fee before work begins, as a fixed fee.
How long does trademark registration take?
Usually a few months if no one files an opposition. Oppositions or objections from the office extend the procedure, which is why a clearance search before filing is worthwhile.
Polish or EU trademark – which should I choose?
A national mark is enough if you operate only in Poland. An EU trade mark covers all EU member states with a single application and pays off when you sell, or plan to sell, abroad.
How long does a registered trademark last?
Ten years, renewable for further ten-year periods. An industrial design can be protected for up to 25 years in total.
What should I do after receiving a trademark cease-and-desist letter?
Do not ignore it, but do not sign any declaration or settlement straight away either. First check whether the mark is registered for your goods and whether the claims are justified.
Can an attorney-at-law file a trademark, or only a patent attorney?
An attorney-at-law (radca prawny) can represent you in trademark matters before the Polish Patent Office. Before the EUIPO I act as a registered professional representative (no. 107937).
